US Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Custody

A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without lawful basis.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The case stems from a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an error. After his return to the United States to answer human smuggling charges, he was held in immigration detention.

In her order, the court pointed out that the authorities lacks a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The legal proceedings involve disputed claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing trial in Tennessee.

The judge, who was hearing his petition to deportation in a federal court, determined that he must now adhere to the terms of his bond from jail in Tennessee. This decision effectively transfers his monitoring to the Tennessee court.
